United States v. Cole (J6 Pipe Bomber case) Counsel for J5 Pipe Bomber Brian J. Cole are still trying to get their client on pretrial release, filing a motion this week to revoke his detention order and in that motion arguing that Cole is not dangerous because, well, according to their own explosives expert, he's not very good at building pipe bombs. United States v. Cole (J6 Pipe Bomber case) Defense has been arguing that Cole should be released for lack of a valid indictment. It's a sort of bizarre situation that could only come about in D.C. Between the return of a new indictment and Cole's arraignment on it, there was a gap that created the possibility of Cole being released for a day. On the docket is an entry titled 'Release from Custody.' But Cole is now in custody, and I don't think he ever was released. United States v. Cole (J6 Pipe Bomber case) No pretrial release for defendant Brian J. Cole Jr. There was an argument for him being released with strict conditions (GPS ankle monitor, at-home detention, 3rd party custodian, random visits, etc.). Defense acquiesced to those conditions in their motion for pretrial release. They also argued that several factors weigh in favor of pretrial release, like zero criminal history, ties to the area, long-term employment, and the fact that the conditions that existed at the time of the charged conduct are no longer present. But the severity of the charged offenses, the weight of the evidence, Cole's behavior post January 5, 2021, and his continued possession of bombmaking materials, as well as the suddenness with which he admitted to constructing and travelling to set the devices, tip the scales in favor of continued custody. The judge's order on this matter is a good read. United States v. Cole (J6 Pipe Bomber case) At the Dec 30th detention hearing, we learned that there is a new 2-count indictment against Cole. However, it has not been accepted by the district judge in this case because it was obtained via a DC Superior Court grand jury and not a US District Court grand jury. This is a new method of acquiring indictments in DC that has come about thanks to the Trump Admin's crackdown on crime in the nation's capital. The method is currently under appeal at the DC Court of Appeals, and so the district judge is hesitant to accept the new indictment. The end result of the hearing was no decision on bond yet and no decision on whether or not to accept the new indictment, though the judge did direct both parties to file briefs on the matter. Cole (J6 Pipe Bomber case) A new filing by prosecutors in support of keeping Cole jailed pending the outcome of the case confirms some early reports about Cole talking with FBI agents for hours and confessing to the crimes. There's some new info in this filing, including that: - The post-arrest interview was hours long and video recorded. - "Over the next approximately one and one-half hours, the defendant walked the interviewing agents in detail through his construction, transportation, and planting of the pipe bombs." - Brian Cole Jr "reset" or "wiped" his Samsung smartphone 943 times between December 2020 and December 2025. - The pipe bombs "were viable explosive devices." - FBI found pipe bomb components in Cole Jr's home and in his vehicle. -"According to the defendant, 'no one knows' his political views, including his family." - "he made the black powder in the devices using charcoal, Lilly Miller sulfur dust, and potassium nitrate that he purchased from Lowes." - He "denied that his actions were directed toward Congress or related to the proceedings scheduled to take place on January 6." - Motive: "he explained that 'something just snapped' after 'watching everything, just everything getting worse.' The defendant wanted to do something 'to the parties' because 'they were in charge.' 'I really don’t like either party at this point.'" Perhaps the most important takeaway from the filing is this: The J5 pipe bombs had nothing to do with the events of J6. Cole Jr. wasn't affiliated with either party or with any group involved in J6. He believed that "everything [was] getting worse," "something snapped" for him on January 5, 2021, and he "wanted to do something 'to the parties' because 'they were in charge.'" He assembled the devices hours before he planted them. It had nothing to do with J6. Cole Jr. is currently in the Rappahannock Regional Jail. Recently, his counsel postponed his bond hearing and then filed for permission from the court for two "in-person mental health evaluations" to be conducted. From the filing, I have the names of the professionals tasked with the evaluations. One is Dr. Clifford Sussman, a child/adolescent psychiatrist and psychotherapist with a focus on "recognizing and treating internet and video game addiction." The other is Dr. David Black, a pediatric neuropsychologist and an expert in autism spectrum and related disorders. Cole has also gained two more attorneys, including one with experience as a federal prosecutor and as a criminal defense lawyer. Looks like Brian J. Cole Jr. will spend Christmas in jail. Prosecutors, at the request of defense counsel, filed a motion requesting a continuance of the detention hearing currently set for Dec 15 to Dec 30. This means that Cole Jr. will remain in a D.C. jail at least until then, as no bond has been set and he has not entered a plea.
