Cities Church Protest

As we expected, or at least hoped for, Don Lemon and several others have been indicted for conspiring to and engaging in a disruption of a church service in St Paul, MN, back on January 18. So, I said, "Hey, maybe the US Attorney will present the indictment and probable cause evidence to a grand jury, and we'll see Lemon arrested before the end of the week." The Court of Appeals for the 8th Circuit has DENIED an emergency petition from DOJ for a writ of mandamus directing the Minnesota District Court to sign a criminal complaint and issue arrest warrants against five individuals involved in the Cities Church protest of January 18, 2026—including Don Lemon and his producer. Remarkably, the Court of Appeals CONCURS with DOJ that "the Complaint and Affidavit clearly establish[es] probable cause for all five arrest warrants," and that "there is no discretion to refuse to issue an arrest warrant once probable cause for its issuance has been shown," meaning the magistrate judge erred in not issuing the arrest warrants. However, the emergency petition is DENIED because "the government has failed to establish that it has no other adequate means of obtaining the requested relief." The district has grand juries available, and they meet Tuesday, Wednesday, and Thursday. Perhaps the US Attorney's Office for Minnesota is presenting a complaint against Don Lemon and the other four invidividuals to one of those grand juries right now. The top three organizers of an ICE protest that invaded and disrupted a Cities Church service in St. Paul, MN, on January 18, 2025, have been arrested and charged with violations of the FACE Act and conspiracy against rights. Those three are Nekima Levy Armstrong, Chauntyll Louisa Allen, and William Kelly.
