Here is the breaking report… CIA Mind Control When the Cold War was at its peak, the CIA began testing the possibility of using mind control to create sleeper agents that would infiltrate communist Russia. The project went by numerous names, but the most famous was Project MK-Ultra. It involved government scientists using methamphetamine, barbiturates, LSD, and hypnosis to break down a subject and then rebuild them with very specific qualities. Needless to say, it didn't work how they wanted it to. The project was scrapped, but not before CIA Director Richard Helms ordered all documents from Project MK-ULTRA to be destroyed. The basic story goes like this: Under President Nixon's orders, a group of men broke into the DNC headquarters at the Watergate complex in order to find dirt on the Democratic party that could be used in upcoming elections. The men were caught, and money that they had on them was traced back to a slush fund used by a committee to re-elect the president. Nixon did his best to cover up the scandal, and even succeeded for a while, but the entire plot unraveled when a tape was released that proved Nixon was trying to cover up the scandal. The CIA Tried To Take Out Castro In the '60s, America tried to assassinate Castro SO MANY TIMES that things kind of got out of hand. So much so that when the information on our many assassination attempts (which included everything from exploding cigars to mafia hits) was declassified almost 40 years after later, it made our government look like writers for Get Smart. The My Lai Massacre The My Lai Massacre was a mass killing of around 500 unarmed civilians that took place during the Vietnam War. Initially, the massacre was reported as a routine battle. But after a helicopter gunner sent a letter to Congress asking them to investigate the incident, the story blew open. Unfortunately, many military officials still see the My Lai Massacre as collateral damage. The Iran-Contra Affair This scandal from the presidency of Ronald Reagan continues to be one of the biggest cover-ups in recent history. Initially, the Iran-Contra deal began as a way for President Reagan to free seven American hostages being held in Lebanon by facilitating the sale of arms to Iran. But after the sale was made, a portion of the money went to fund anti-Sandinista and anti-Communist rebels in Nicaragua. Even after all of this information was released, Reagan's involvement with the deal has remained classified, and the few convictions that were handed down to lower-level government agents were either overturned or the men were pardoned by President George H.W. Bush during the final year of his presidency. The Teapot Dome Scandal In the early 1920s, the Teapot Dome scandal rocked America when it was revealed that the Secretary of the Interior had been leasing Navy petroleum reserves at super low rates without competitive bidding. The Majestic 12 The Majestic 12 is the code name of a supposed secret committee of 12 scientists, military leaders, and government officials formed by President Truman in 1947 under the auspices of recovering and investigating a downed alien aircraft. Then, the US would assume power from within to create peace between Germany and the Western Allies. Unfortunately, the plot failed, which led to the arrest of at least 7,000 people by the Gestapo. HAARP HAARP was an ionospheric research facility in Alaska, and the scandal surrounding it remains one of the most widely contested government cover-ups ever. Social Security Is Gone and Remember, not only did you and I contribute to Social Security, but your employer did, too. It totals 15% of your income before taxes. We are talking about the money you and your employer put in a Government bank to insure you and I that we would have a retirement check from the money we put in, not the Government. Here are 15 fake-sounding conspiracy theories that turned out to be true. Watergate Scandal One of the most well-known political scandals was Watergate. In the 1970s, five men broke into the Democratic National Committee’s headquarters with the intention to photograph campaign documents. They were caught, and the Nixon administration attempted to cover-up its involvement. This eventually lead to Nixon’s resignation and the indictment of 69 people who were involved in some form. Operation Paperclip After World War II, the United States created a secret Joint Intelligence Objective Agency in which they brought more than 1,600 German scientists, engineers, and technicians – many of whom had direct ties to the Nazi Party – to work for the government. Known as Operation Paperclip, its primary focus was for the U.S. to gain an advantage in the Cold War. Operation Snow White The Church of Scientology didn’t want anything bad about them on record, and they went to criminal means to do it. Called Operation Snow White, it included an estimated 5,000 covert agents of Church members who infiltrated 136 government agencies to scrub unfavorable records about Scientology and its founder, L. Ron Hubbard. USS Iowa Turret Explosion In 1989, an explosion occurred on the USS Iowa and killed 47 of the crewman who were manning a 16-inch gun turret. To explain what happened, two investigations occurred but came to conflicting conclusions. According to the U.S. Navy, one of the crew members, Clayton Hartwig, had deliberately caused the explosion because of a homosexual relationship with a fellow crew member that went awry. After further investigation, however, the cause was concluded to be because of an excess of powder bags into the breach of the turret. The Navy never admitted to wrongdoing. Blackbox Scandal The Blackbox Scandal accused eight members of the Chicago White Sox of deliberately losing the 1919 World Series against the Cincinnati Reds, in exchange for money. After a public trial in 1921, the men were all permanently banned from professional baseball. The “Fruit Machine” The idea of “gaydar” – the ability to tell whether or not someone is gay – might seem silly nowadays, but back in 1961, it was real. At the height of the Cold War, the Canadian government hired Frank Robert Way to create a scientific test that’d determine if someone was gay. The reason for this was to identify communist sympathizers and get them out of the government. Project MKultra Project MKultra, aka the CIA’s mind control program, lasted about 20 years and was a sanctioned way for the agency to perform experiments on human subjects. Most famously, they gave people LSD to “unwitting subjects in social situations.” To administer these tests, no medical personnel was available – often, this resulted in subjects being sick for days. Gulf of Tonkin Incident The fictitious Gulf of Tonkin helped draw the United States deeper into the Vietnam War. Originally, it was claimed by the National Security Agency that the North Vietnamese Navy fired torpedo boats towards the USS Maddox on August 4, 1964. But, what was later discovered were “Tokin ghosts” (aka false radar images) and no evidence of the boats. But that didn’t matter; because the Gulf of Tonkin never happened, but was used as an excuse for the U.S. expanding warfare against North Vietnam. Bohemian Grove Every July, some of the “richest and most powerful men in the world” head to Bohemian Grove, a 2,700 acre campground in California to engage in a series of hush-hush ceremonies that also include costumes, theatre, and music. It may or may not include former U.S. presidents, oil tycoons, and other business leaders freely urinating on Redwood trees. CIA Giving Money to Tibetan Exiles Determined to undermine Communist governments, the CIA gave $1.7 million a year to Tibetan exiles in their efforts against China. This also included payments to the Dalai Lama, which amounted to $180,000 annually. “The purpose of the program,” explained in a memo written by U.S. intelligence officials, “is to keep the political concept of an autonomous Tibet alive within Tibet and among foreign nations, principally India, and to build a capability for resistance against possible political developments inside Communist China.” Abraham Lincoln’s Assassination John Wilkes-Booth is talked about in history books as being the man who killed President Abraham Lincoln. But it turns out that he didn’t act alone. Nine other people were found to assist Wilkes-Booth in some way – including a woman named Mary Surratt, who was the first woman to be executed by the United States. Human Tissue Collected for Atomic Bomb Tests “Project Sunshine” doesn’t sound so sunny when you find out what it’s about. In the 1950s, the U.S. government secretly collected human tissue – primarily from cadavers, without permission from next of kin. The purpose was to monitor the effects of radioactive fallout from nuclear weapons tests. More than 1,500 samples (many of them babies) were gathered around the world. Dr. Willard Libby, a researcher and commission member, is quoted as saying, “I don’t know how to get them [human samples], but I do say that it is a matter of prime importance to get them and particularly in the young age group. So, human samples are of prime importance, and if anybody knows how to do a good job of body snatching, they will really be serving their country.” Bayer Medicine Causes AIDS In the mid-1980s, pharmaceutical company Bayer discovered that their blood-clotting medicine for hemophiliacs carried a high risk of transmitting AIDS. They fixed the problem in 1984, but didn’t pull the dangerous product from the market. Instead, they sold it to Asia and Latin America, while Europe and the United State got the newer version. The Testimony That Helped Launch the Gulf War On October 10, 1990, a 15-year-old girl known only as Nayirah gave a tearful testimony that recounted a terrifying event; she said she witnessed Iraqi soldiers take babies out of incubators in a Kuwaiti hospital, take the incubators, and then leave the children to die. This harrowing description helped the U.S. rationalize their decision to back Kuwait in the Gulf War. But Nayirah’s testimony was proven false. She was actually the daughter of Saud Al-Sabah, the Kuwaiti ambassador to the United States. Tuskegee Syphilis Study The Tuskegee Syphilis Study is one of the most infamous clinical studies in American history. Conducted between 1932 and 1972, it observed the natural progression of syphilis in black men in rural Alabama. Unfortunately, this was not known to those involved in the study – they thought they were receiving free health care from the government. Bad booze 1920 Poisoned Alcohol Conspiracy: During Prohibition, the government poisoned alcohol to keep people from drinking. The truth: Manufacturers of industrial alcohol had been mixing their product with dangerous chemicals for years prior to Prohibition. But between 1926 and 1933, the federal government pushed manufacturers to use stronger poisons to discourage bootleggers from turning the alcohol into moonshine. In 1962, the CIA planned to stage terrorist attacks on American citizens and military targets in Miami and Washington, blame it on the Cuban government and convince the American public to wage war on Cuba, which had, under the direction of Fidel Casto, recently become communist. The plan involved killing innocent people and soldiers, blowing up U.S. ships and Cuban refugee boats, hijacking airplanes and planting phony evidence to implicate the Cuban Government. Operation Northwoods was authorized by the Joint Chiefs of Staff and presented to the Secretary of Defense, Robert McNamara, before President John F. Kennedy rejected it. Of all of the great things JFK is remembered for, we should be most thankful that he had the power to stop this buffoonery. Operation Paperclip: Nazi Scientists Find Employment in America In 1945, the Joint Intelligence Objectives Agency was given authorization to offer over 1,500 German scientists, technicians, and engineers from Nazi Germany and other countries employment in America. President Truman agreed to the program with the explicit instructions that it only includes those who were not found “to have been a member of the Nazi party, and more than a nominal participant in its activities, or an active supporter of Nazi militarism.” This meant that Wernher von Braun, Arthur Rudolph, and Hubertus Strughold, who were listed as a “menace to the security of the Allied Forces,” would not be allowed to find new employment in America. The Joint Intelligence Objectives Agency decided these men were of vital importance to the development of the U.S. rocket program, created false employment and political biographies for the scientists and completely destroyed all evidence connecting them to the Nazi war machine. COINTELPRO: The FBI vs. 1960s Activists The 1960s were a time of radical social change. According to FBI records, 85% of the programs resources were spent on marginalizing, infiltrating and disrupting groups, such as the women’s rights movement, the non-violent civil rights movement, the Congress of Racial Equality, the American Indian Movement, and other civil rights groups. FBI Director J. Edgar Hoover ordered FBI agents to “expose, disrupt, misdirect, discredit, or otherwise neutralize” the activities of these movements and their leaders. Operation Mockingbird: The CIA Propaganda Machine In 1948, Frank Wisner was appointed director of the Office of Special Projects and told to create an organization that was capable of producing propaganda and engaging in economic warfare as part of the global war against Soviet Communism. The CIA took control of the office in the 1950s and maintained a secret campaign to influence media around the world for almost 25 years. Wisner “owned” respected members of The New York Times, Newsweek, CBS and other media outlets. By the 1950s there were around 3,000 CIA employees and dozens of large global media outlets working to maintain a complex propaganda machine. Wisner, who was always looking for new ways to convince the public of the dangers of communism, facilitated the 1954 animated Hollywood production of George Orwell’s Animal Farm. The Church Committee exposed the conspiracy in 1975 and calculated that misinforming the world cost taxpayers $265 million a year. The Business Plot: Fascism in America In 1933, Senator Prescott Bush – father of George Bush Sr. and grandfather of George W. Bush – tried to create a military coup against President Franklin D. Roosevelt and install a fascist dictatorship in the United States. The plot included wealthy businessmen from Chase Bank, Goodyear, Standard Oil, GM, and the Du Pont family. Marine Corps Major General Smedley Butler was asked to lead the coup. Apparently no one did a background check before they approached him. Smedley Butler, who was a vocal supporter of FDR, gathered evidence of the conspiracy and presented it to a Congressional Committee. Everyone implicated in the plot fiercely denied any involvement and no criminal charges were ever filed. The Committee confirmed Butler’s allegations, but was satisfied with having the conspiracy stopped before it started. The people who backed the Business Plot maintained financial ties with Nazi Germany until America entered World War II. CIA Assassinations In 1975, after the Watergate scandal, Senator Frank Church helped form the precursor to the U.S. Senate Select Committee on Intelligence. Commonly referred to as the Church Committee, their purpose was to investigate the CIA and FBI to ensure that they were operating within the law. The Committee quickly discovered that the CIA had started a hit man business. The CIA were responsible for the assassinations of Mossadegh in Iran, Allende (below) in Chile, as well as other leaders and revolutionaries in Central and South America, Africa, the Middle East and Eastern Asia. They made their assassinations appear like car accidents, suicides, cancers, and heart attacks. When their declassified “Heart Attack Gun” wasn’t necessary, they would just shoot their targets with actual bullets. While all of this is part of the congressional record, it’s still common for people to laugh this one off as a nutty conspiracy theory. Operation Snow White: The Church of Scientology Versus The U.S. Government During the 1970s, 5,000 covert agents from L. Ron Hubbard’s Church of Scientology conspired to perform the largest infiltration of the U.S. government in American history. The church infiltrated 136 organizations including the IRS, the DEA, foreign embassies and other government agencies. They installed wiretaps and stole hundreds of documents with the hopes of protecting their church and from paying millions of dollars in taxes. The U.S. government fought back. In July of 1977, the FBI organized a raid of various Scientology locations involving 156 agents. The raid uncovered the group’s illegal actions against the government as well as additional conspiracies against other perceived enemies of the church. On December 6, 1979, Operation Snow White ended when Mary Sue Hubbard, wife of L. Ron Hubbard, and 10 other high-ranking Scientologists received five-year prison sentences. L. Ron Hubbard remained an “unindicted co-conspirator” and spent the rest of his life in hiding. The 1990 Testimony of Nayirah In October of 1990, a 15-year-old girl named Nayirah offered testimony to the U.S. Congress stating that she had witnessed Iraqi soldiers taking 15 Kuwaiti babies out of incubators and leaving them on the floor to die. This testimony aired on about 700 television stations throughout the United States. President George Bush Sr. repeated the story at least 10 times in the following weeks in an attempt to sway public opinion towards supporting the Gulf War. The problem is that the events described by Nayirah were a complete fabrication. The CIA requested that Nayirah receive acting lessons before she testified. It was also discovered that Nayirah was the daughter of the Kuwaiti ambassador to the U.S. who worked with the Kuwaiti government to promote U.S. involvement in the Gulf War. In response to these findings, Amnesty International accused the Bush administration of “opportunistic manipulation of the international human rights movement.” MKUltra: the CIA Mind-Control Project It’s the 1950s and Communist spies are everywhere. The cold war is heating up and it looks as though the Soviet Union might gain the upper hand on American Democracy. What would you do? With the hopes of discovering a “truth serum,” the CIA decided they needed to secretively dose unwitting U.S. and Canadian citizens with LSD, and then interrogate and occasionally torture the participants. The CIA paid hospitals, prisons and universities for their participation and their silence. In 1973, CIA director Richard Helms ordered that all documents related to MKUltra be destroyed. While the conspiracy was eventually uncovered, nobody involved in the project “remembered” the details and a complete timeline of events remains incomplete. Tuskegee Syphilis Experiment In 1932, the U.S. Public Health Service conspired with the Tuskegee Institute to create a phony syphilis treatment program. The experiment, which involved lying to almost 400 African-American men who had been diagnosed with syphilis, was initially only supposed to last six months. It took until 1972 before the public became aware of the research and the government was forced to investigate and shut the program down. For 40 years these 400 men were often given dangerous chemicals and offered painful and unnecessary medical procedures under the guise of actual treatment. The fact that penicillin had become a known cure for syphilis was hidden from the patients so that the researchers could learn more about the disease. A government panel eventually deemed the study “ethically irresponsible” and in 1974, a class action suit was settled out of court for $10 million with lifetime health benefits for the surviving participants. There are plenty of conspiracy theories out there that help fuel the imaginations of the truly paranoid; NASA faked the moon landing, Paul McCartney has been dead since 1967, 9/11 was an inside job, and hybrid lizard humanoids are the real rulers of planet Earth. True Titles Of Nobility Our early legislators were so concerned regarding the "still" close relationship with the British Crown hence Article I, Section 9, Clause 8 which is included in the Constitution. The Titles of Nobility Amendment was proposed in 1810 and submitted to the states for ratification. By early 1812, eleven states had ratified the amendment. However, it required ratification by thirteen states to become part of the Constitution. On February 27, 1818, President James Monroe communicated to Congress that the required number of ratifications had not been reached. The amendment was rejected by Virginia (February 14, 1811), New York (March 12, 1812), Connecticut (May 13, 1813), and Rhode Island (September 15, 1814). No other state legislature has completed ratification action on it. The amendment would have stripped United States citizenship from any citizen who accepted a title of nobility from an "emperor, king, prince or foreign power". It was introduced in the Senate by Democratic–Republican Senator Philip Reed of Maryland and passed by Congress on May 1, 1810. The amendment was intended to prevent U.S. citizens from accepting titles of nobility from foreign powers, reflecting concerns about European influence on the young republic. Return with us now to the tumultuous years leading up to the War of 1812, when fear of "foreign influence"—by England or France, depending on whether you were a Republican or Federalist—was a dominating issue in American politics. Jerome Bonaparte, the younger brother of Napoleon, had recently spent several years in the United States, where he married Elizabeth Patterson, the beautiful, ambitious daughter of a wealthy Baltimore merchant. In 1810, Jerome was on the throne of Westphalia, while Elizabeth was in America with their son, Jerome Napoleon. (The couple would never see each other again.) According to historian Michael Vorenberg of Brown University, having a nephew of the emperor of France growing up on American soil might have made the pro-British Federalists uneasy, or, just as likely, suggested to them a way to tie the Republicans to the French Legion of Honor, the Trilateral Commission of its day. Desiring to get out in front of the issue—or possibly seeking to score points against the Federalists, who had their own embarrassing ties to the British aristocracy—Republican Sen. Philip Reed of Maryland introduced an amendment meant to strengthen the existing "emoluments clause" in Article I, Section 9, of the Constitution. This clause reads: "No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State." Reed's proposed amendment extended the ban from office-holders to "any citizen of the United States" and made the penalty loss of citizenship: "If any citizen of the United States shall accept, claim, receive or retain any title of nobility or honour, or shall, without the consent of Congress accept and retain any present, pension, office or emolument of any kind whatever, from any emperor, king, prince or foreign power, such person shall cease to be a citizen of the United States and shall be incapable of holding any office of trust or profit under them, or either of them." Reed's bill passed both houses easily, and as of Dec. 9, 1812, had been ratified by 12 states and seemed headed for adoption, at which point war intervened. Here, histories diverge. The mainstream view is that the "Titles of Nobility Amendment" (TONA) never achieved the necessary 13 ratifications—three quarters of the 17 states as of 1810—and fell further behind as more states joined the union. That ought to have been the end of it, says Jol A. Silversmith, a lawyer in private practice who has written the definitive account of the "missing amendment." And so it was until the 1980s, when a conspiracy-minded researcher named David Dodge came across an 1825 copy of the Constitution including this provision. Further research led Dodge to conclude that TONA had been ratified by Virginia no later than 1819 and was an accepted, if largely unnoted, part of the Constitution from then until its mysterious disappearance around the time of the Civil War. If you find it hard to believe that an amendment to the Constitution could have been in effect for four decades and then mysteriously excised and forgotten, well, the times were different. There was no single reference copy of the Constitution to which scribes with quill pens ceremoniously added amendments as they were ratified. Dodge claims to have turned up numerous pre–Civil War copies of the Constitution containing the missing amendment, but that doesn't add up to proof. Even Congress was confused about the status of TONA and requested clarification from President James Monroe, who turned the question over to Secretary of State John Quincy Adams, who reported that it had not been ratified. The evidence that Virginia ever did approve TONA is circumstantial, but, as Silversmith points out, it's also irrelevant, because already by April 30, 1812, with the admission of Louisiana, ratification required 14 states (of 18). To hang the argument on what Virginia may have done in 1819 assumes that adoption required ratification only by three quarters of the states in the union at the time the amendment was submitted in 1810, i.e., 13 of 17. That view has had its adherents over the centuries, but apart from its inherent illogic—surely the high hurdle the Founding Fathers erected to Constitutional amendments wasn't meant to shrink as the country grew—we now have a clear precedent that establishes the opposite. That's the 27th Amendment (on Congressional pay), which was proposed in 1789 but was deemed ratified only in 1992 when it was passed by 38 states—three quarters of 50, not of 13. In the world of the Thirteenthers, though, it's all a conspiracy, and the leading suspects are those shady characters who put "esquire" after their names. To quote the Web site Constitutional Concepts, "This Amendment was for the specific purpose of banning participation in government operations by attorneys and bankers who claimed the Title of Nobility of 'Esquire.' These people had joined the International Bar Association or the International Bankers Association and owed their allegiance to the King of England." In other words—well, we're not sure how to explain it any better, but Constitutional Concepts CEO Jim Barrus says in an e-mail that enforcement of the 13th Amendment would strike a blow against "the elected politicians who have grand plans of ruling every facet of America," and would essentially delegitimize virtually every act of the federal government since 1819. Who wouldn't want that? Naturally, most lawyers see it differently. "The esquire thing is ridiculous," says R. B. Bernstein, a professor at New York Law School and author of Amending America. "'Esquire' is not a title of nobility. Back then, they were worried about people accepting literal titles of aristocracy that convey land or privileges, things you can leave to your kids." Lawyers obviously command certain privileges, but they are not inherited. There are, of course, other implications of Thirteenthism, such as ensuring that the United States never again suffers the humiliation of having a president win the Nobel Peace Prize. That was just what the Iowa Republicans had in mind, according to Plogmann, who wrote in an e-mail that the plank "was meant to make a statement about the delegates' opinion about Mr. Obama receiving the prize." (Presumably they didn't mind if, in the process, they were also making a statement about any American scientist or writer unlucky enough to win a Nobel.) Unfortunately for them, the Department of Justice looked into whether Obama needed Congressional approval to accept the Nobel under the existing emoluments clause, and based on the meaning of "foreign state" (which would not cover the Nobel Prize Committee) concluded that he did not. But they could be playing with fire. "We're in a constitutional silly season," says Bernstein, "and whether you are of the left or the right, if you take the Constitution seriously, it's very troubling." The threat posed by the 13th Amendment is remote; as far as can be determined, no other state has followed the Iowa GOP in calling for ratification, and no bill of ratification has been introduced into the Iowa legislature. Republicans claimed the legitimate 13th Amendment to the Constitution was “missing.” The debate is part of a historical detective story with some surprising twists that is still taking place.The Daily Beast did a fairly extensive feature on the missing amendment in 2010, which didn’t feature a cloaked Freemason stealing the amendment because it had a secret treasure map printed on it. Instead, the debate between historians and conspiracy buffs is about an amendment that was almost ratified in 1812 that would have been the 13th Amendment, bumping back the current 13th Amendment--which was ratified on this day in 1865 and abolished slavery--to the position of the 14th Amendment. Writer Jerry Adler’s 2010 explanation of the “Thirteenthers” controversy is pretty detailed and covers both sides of the issue—which isn’t new but got a big burst of publicity thanks to the Iowa GOP’s 2010 platform. The Iowa Republicans didn’t want the current 13th Amendment banned; they just wanted the “original” one reintroduced for approval. That "missing" proposal was called the “Titles of Nobility Amendment” (or TONA). It sought to ban any American citizen from receiving any foreign title of nobility or receiving foreign favors, such as a pension, without congressional approval. The penalty was loss of citizenship. It was an extension of Article I, Section 9, of the Constitution, which doesn’t allow a public office holder to receive a foreign title or similar honors without the consent of Congress. Today, the idea of a constitutional controversy about the royals may seem kind of silly, but in 1812, the United States was fighting the British and had a rocky relationship with France. The fear of both nations using noble titles as bribes, along with pensions from a foreign government, was persistent. And both the Senate and the House easily passed the TONA and passed it on to the states. By late 1812, a total of 12 states had approved the 13th Amendment and ironically, it needed a 13th state to become ratified. As the War of 1812 escalated, the TONA faded away as an issue and was never ratified. Or so we think. In the 1980s, Adler says a researcher started finding copies of the Constitution from the pre-Civil War era that had TONA listed as the 13th Amendment. The premise was that Virginia’s legislature had approved the amendment in 1819, but somehow, it was never listed as accepted by the federal government. Further research revealed that President James Monroe asked his Secretary of State, John Quincy Adams, to confirm that the TONA was never ratified, which he did. A law journal article from 1999 by Jol A. Silversmith, an attorney, explains how the TONA appeared in widely published versions of the Constitution for more than 30 years, including the official United States Statutes at Large (an official compilation of laws published by the government in 1815). His well-documented article of the “missing” amendment has more than 200 footnotes and a lot of interesting stories about how the Founding Fathers couldn’t keep track of new amendments they had just passed. As the story goes, the editor of the 1815 book of statutes, John Colvin, couldn’t determine if the TONA amendment has been ratified, so he included it in the book with an explanatory note. Then, an official version of the Constitution was given to Congressional members that included the TONA as the 13th Amendment, as an apparent misprint. That triggered a request for Monroe and Adams to verify that the amendment hadn’t been ratified. The United States Statutes at Large wasn’t reprinted until 1845, so the mistake became part of textbooks, state publications, and newspapers, Silversmith said, for decades. So a whole generation of Americans lived during a time when the “phantom” 13th Amendment existed, in some publications. (And with any kind of luck, you can probably find a TONA version of the Constitution at a flea market.) Silversmith also said Virginia's Senate rejected the TONA on February 14, 1811, based upon information in its records. But an official letter or note from the Virginia legislature couldn't be found several years later. But how could the Founding Fathers and their heirs become so confused by a handful of amendments? President John Adams waited three years to acknowledge the 11th Amendment as law, and it took Secretary of State James Madison (the "Father of the Constitution") three months to recognize the 12th Amendment as an effective law. Part of the issue was the lack of a process for states to communicate to the federal government that they had voted in favor of an amendment. Also, the number of states kept changing, which added more confusion to the ratification process. Today, TONA supporters have made several legal challenges to get the “original” 13th Amendment recognized. The issue hasn’t been taken up by the Supreme Court, and Silversmith wrote that a 2005 U.S. district court ruling said that based on Article V of the Constitution, the inclusion of TONA in published documents doesn’t make it an amendment. That hasn’t kept the debate over TONA off the Internet, as there are many websites that claim it is the legitimate 13th Amendment. And there is no expiration date for the TONA amendment, which means that it can be introduced to 35 more states that didn’t vote on it originally. It may seem that preposterous that an amendment from the early 1800s could still become a law today, but the 27th Amendment was proposed in 1789 and finally approved in 1992. The Missing Amendment in the Bill of Rights. Since the ratification of the Constitution, thousands of constitutional amendments have been proposed, but only 27 have survived the process of Article V. Out of these, the most well known are the first 10, also known as the Bill of Rights. Interestingly, 12 amendments were originally proposed, including one on congressional compensation. This proposal later became our 27th amendment, which celebrates its 20th anniversary today. This amendment boasts the longest ratification process of any amendment—200 years! Under the Compensation Clause, Congress has the power to control its own salary. The Anti-Federalists and others at the state-ratifying conventions rightly objected to the danger of allowing this power. In response, James Madison proposed a compensation amendment stating that pay increases would apply only to the next Congress. It read: “No law, varying the compensation for the services of the Senators and Representatives, shall take effect, until an election of representatives shall have intervened.” This change allowed the voters to force Congress to justify their pay increases through an election. Both the House and Senate approved the proposal and sent it (along with 11 other proposed amendments) to the states. The states ratified only 10 of these, now known as the Bill of Rights, but the compensation amendment remained in limbo until the 1980s. In the early 1980s, a Texas undergraduate student’s term paper renewed the ratification effort. Arguing that the amendment’s ratification was still pending, the student raised support across the country on the amendment’s behalf. At the beginning of his campaign, only seven states had ratified the amendment, but thanks to his efforts, Michigan became the final 38th state to ratify the amendment in 1992. It requires that the President recite the following statement upon taking office: ( “I do solemnly swear (or affirm) that I will faithfully execute the office of president of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.” ) Some legal observers believe that the presidential oath reflects a unique personal duty to shield the Constitution from external and internal threats to its integrity and sustainability.
