Both James Comey and Letitia James have filed motions to dismiss, arguing that Lindsey Halligan's appointment is unlawful. If successful, these motions could result in the cases against Comey and James being dismissed. However, Attorney General Pam Bondi has issued a new order defending the appointment, designating Halligan as a "Special Attorney" with explicit authority to prosecute both Comey and James. The order endorses the prosecutions and the underlying grand jury proceedings. Additionally, the Department of Justice has joined prosecutors in both cases to file a response opposing the motions to dismiss. The filing is well-written and highly persuasive. In United States v. Comey, the defense has filed a motion seeking disclosure of grand jury transcripts and audio recordings. Fed Rule 6(e)(3)(E)(ii) allows for the disclosure of grand jury materials when a defendant “establish[es] that particularized and factually based grounds exist to support the proposition that irregularities in the grand jury proceedings may create a basis for dismissal of the indictment.” The irregularities with this case are apparent and notable. Update on United States v. Comey: a new filing from the defense opposes the implementation of a filter team for Arctic Haze evidence seized years ago from Daniel Richman, who was counsel to Comey at the time and is now Person 3 from the indictment. Defense wants to first challenge the underlying search warrants used to get that evidence, which appears to be communications between Comey and Richman. To do that, they need prosecutors to turn over the four search warrants used. Defense’s filing gives us new insights into the Arctic Haze investigation and, in my opinion, foreshadows what this case is really about—sealed material and getting it unsealed. Most exciting, though, is a new highly interesting article from the New York Times that provides details of the involvement of at least four US attorneys’ offices in a multifaceted investigation of RussiaGate, including mishandling or even destruction of classified information, manipulation and weaponization of intelligence, and potential misconduct by FBI and CIA officials.
