United States v. Comey

Halligan was disqualified from the role in November 2025 by a federal district judge, who ruled that her appointment—as an interim U.S. Attorney for the Eastern District of Virginia—was unlawful (similar to at least four other interim appointments). Despite the order, and while it was under appeal, she continued to make filings and act in the position as if the ruling were a mere fever dream. The office's highest-profile cases over the past six months—the prosecutions of James Comey and Letitia James—should never have been brought. Trump's initial choice for the office, Erik Siebert, along with other investigators, determined over the summer that there was no viable case against Comey and declined to pursue it. That decision triggered firings and resignations. Trump then asked Attorney General Pam Bondi to install Halligan in the role. The James case was weak, but the Comey case was especially flawed: it suffered from errors in the grand jury process, fatal factual defects in the indictment, and violations of the rights of both the defendant (Comey) and a key witness (Daniel Richman). Before Halligan's appointment, Trump's original pick (Siebert) was effectively forced out (fired or resigned, depending on the account), and other career prosecutors quit. More recently, Halligan's right-hand prosecutor was also fired. Now Halligan is out, and those high-profile Comey and James cases will almost certainly be abandoned. The U.S. Attorney's Office for the Eastern District of Virginia is now leaderless, understaffed, and destabilized. And for what? This has been a hugely damaging saga for the office, for Bondi, and for Trump. (Disqualified) Interim US Attorney Lindsey Halligan's 120-Day Appointment is Up. The United States District Court for EDVA has posted a vacancy notice, seeking someone to run that office. Even if you accept the argument that Halligan was lawfully appointed and should not have been disqualified, which is currently under appeal at the Fourth Circuit,... her time is up. Comey's Closeted Intelligence The FBI Opening EC that was disclosed in a filing in United States v. Comey tells us that a highly interesting document and a key piece of the Russiagate scandal was discovered in Room 9582, FBI HQ, Washington, D.C. "This [Counterintelligence Operational Lead, or CIOL], believed to have been missing for several years, was dated September 07, 2016, and contained certain intelligence related to the 2016 U.S. presidential election campaign." The Opening EC, dated July 21, 2025, is for a preliminary investigation into violations of 18 USC 2071—Concealment, Removal, or Mutilation Generally of Capstone and/or Government Records, and related crimes. One of those crimes may be the stuffing of critical Russiagate intelligence into a closet at FBI HQ instead of into the hand of then-FBI Director James Comey. If this intelligence had not been concealed, as it appears it was, the shape, course, and targets of Crossfire Hurricane and its associated investigations may have been altered. Yet another filing from Halligan seeking to clarify the grand jury proceedings that have been the focus of scrutiny over recent days and really, since day one in this case—as the just-filed Transcript of Return of Grand Jury Indictment Proceedings shows. Through multiple filings and this transcript, I think Halligan has mostly recovered the situation. Some weirdness and discrepancies remain, though. WHY has it taken multiple filings, inquiries from three (truly four) judges, and many weeks to get to the understanding that we now have of the return of this indictment? It's almost like they either want this back and forth on the issue OR they are a prosecution playing defense. A new filing by US Attorney Halligan clarifies that "the foreperson of the grand jury 'reported that 12 or more grand jurors did not concur in finding an indictment' as to proposed 'Count 1 only,'" but did concur on Counts 2 & 3. So she made an edit. The 3-count indictment was changed to a 2-count indictment, numbers adjusted, and the foreperson signed the new one. There was no need to re-present it to the full grand jury, and the indictment should stand. Can she do that? The way she explains it makes sense. In this episode, we go over the criminal case against multiple Antifa-affiliated defendants who recently received either a plea deal OR a superseding indictment, which added new charges—including rioting, attempted murder, and terrorism. Then we turn to the criminal case against Comey and the numerous significant issues that are elucidated in a new ORDER and MEMORANDUM from Magistrate Judge Fitzpatrick. Though U.S. Attorney Halligan was able to get a STAY on that order, the case appears to be in dire straits, as missteps, misconduct, violations of the defendants’ rights, and improper procedures before the grand jury by Halligan and others involved in the investigation have surfaced. Perhaps there are reasonable explanations for all those issues. We may get those explanations before the end of this week.
