Comey's Closeted Intelligence The FBI Opening EC that was disclosed in a filing in United States v. Comey tells us that a highly interesting document and a key piece of the Russiagate scandal was discovered in Room 9582, FBI HQ, Washington, D.C. "This [Counterintelligence Operational Lead, or CIOL], believed to have been missing for several years, was dated September 07, 2016, and contained certain intelligence related to the 2016 U.S. presidential election campaign." The Opening EC, dated July 21, 2025, is for a preliminary investigation into violations of 18 USC 2071—Concealment, Removal, or Mutilation Generally of Capstone and/or Government Records, and related crimes. One of those crimes may be the stuffing of critical Russiagate intelligence into a closet at FBI HQ instead of into the hand of then-FBI Director James Comey. If this intelligence had not been concealed, as it appears it was, the shape, course, and targets of Crossfire Hurricane and its associated investigations may have been altered. In this video I brief you on two distinct threats to United States v. James Comey, one of which could result in a dismissal in the next few days. The two threats are 1) a ruling by Judge Currie on Comey’s motion challenging the appointment of Lindsey Halligan and 2) Judge Nachmanoff’s review of irregularities in the grand jury proceeding and Comey’s motion for disclosure of those proceedings. Yet another filing from Halligan seeking to clarify the grand jury proceedings that have been the focus of scrutiny over recent days and really, since day one in this case—as the just-filed Transcript of Return of Grand Jury Indictment Proceedings shows. Through multiple filings and this transcript, I think Halligan has mostly recovered the situation. Some weirdness and discrepancies remain, though. WHY has it taken multiple filings, inquiries from three (truly four) judges, and many weeks to get to the understanding that we now have of the return of this indictment? It's almost like they either want this back and forth on the issue OR they are a prosecution playing defense. A new filing by US Attorney Halligan clarifies that "the foreperson of the grand jury 'reported that 12 or more grand jurors did not concur in finding an indictment' as to proposed 'Count 1 only,'" but did concur on Counts 2 & 3. So she made an edit. The 3-count indictment was changed to a 2-count indictment, numbers adjusted, and the foreperson signed the new one. There was no need to re-present it to the full grand jury, and the indictment should stand. Can she do that? The way she explains it makes sense. In this episode, we go over the criminal case against multiple Antifa-affiliated defendants who recently received either a plea deal OR a superseding indictment, which added new charges—including rioting, attempted murder, and terrorism. Then we turn to the criminal case against Comey and the numerous significant issues that are elucidated in a new ORDER and MEMORANDUM from Magistrate Judge Fitzpatrick. Though U.S. Attorney Halligan was able to get a STAY on that order, the case appears to be in dire straits, as missteps, misconduct, violations of the defendants’ rights, and improper procedures before the grand jury by Halligan and others involved in the investigation have surfaced. Perhaps there are reasonable explanations for all those issues. We may get those explanations before the end of this week. In United States v. Comey, Magistrate Judge Fitzpatrick once again finds that disclosure of grand jury materials is warranted in this case. After examination of the grand jury process, transcript, and materials, he finds almost a dozen problems with how Halligan conducted and informed the grand jury. Therefore, there is more than sufficient basis for disclosure of those grand jury proceedings and materials to the defense so that they can also examine them and, if warranted, construct motions to dismiss based on what's in them. Fitzpatrick ORDERED DOJ to turn over ALL grand jury materials to the defense by 3pm and all audio recordings by 5pm Monday. However, just hours after Mag. Judge Fitzpatrick's order, prosecutors won an EMERGENCY STAY from District Judge Nachmanoff. They have just two days to file objections to the order for grand jury disclosure, just two days to explain to Judge Nachmanoff that Fitzpatrick's ELEVEN findings of misconduct, misstatement of law, errors in the grand jury process, sharing of attorney-client privileged information, and possible violations of Comey's Fourth and Fifth Amendment rights—just two days to convince Nachmanoff that Fitzpatrick erred in his order. In this episode, I bring you up to speed on the latest filings in United States v. Comey, particularly regarding the grand jury proceedings that generated the indictment and the issue of Lindsey Halligan’s appointment as Interim U.S. Attorney for the Eastern District of Virginia. One judge is examining whether or not privileged material was shared with the grand jury, and another judge is considering the lawfulness of Halligan's appointment. Both issues have the potential to sink the case. In support of their case and the appointment, DOJ has filed new affidavits from two FBI agents and one each from Attorney Halligan and AG Bondi, plus a timeline of the grand jury proceedings. Next, I walk you through a newly disclosed 2017 email chain about a potential investigation into the Hillary Clinton campaign’s payment for the Steele Dossier. An FBI agent sought to open the probe and requested advice on proceeding from a key figure in the DOJ’s Public Corruption Unit and a chief legal official in the U.S. Attorney’s Office for the District of Columbia. Both advised against pursuing it. The email chain was provided to Senator Grassley by FBI Director Patel and Attorney General Bondi after Grassley was tipped off by a whistleblower. Finally, in the show’s final hour, I present a “for your consideration”-style segment. I take you back to 2016 and revisit the early months of Crossfire Hurricane and Russiagate, framing the saga in a fresh—or perhaps evolved—light.
