Berry was accused of shooting Justin Howell during the May 30th, 2020 protests. the Austin city council awarded Howell $8 million in February 2022.

late Feb 2022, Grand jury indicted him along with 18 other Austin officers for first degree felony of aggravated assault by a peace officer. In which Abbott replied w a statement the first of March that he possibly will use his executive powers to pardon all the officers if they are convicted along with endorsing Berry for the house seat.
