If you hope to win Social Security disability benefits, you have to PROVE to the SSA that you have a medical condition that prevents you from performing the duties of a simple job, and, that your medical issues have lasted or are expected to last 12 consecutive months.

The 12 month part of SSA’s definition of disability is called the "DURATION REQUIREMENT" and it confuses many people. I hope to offer a clear explanation in this new video.

If you have already been out of work for the past year or longer, and your absence from work was due to a serious medical condition, you CAN apply for benefits. The 12 month duration requirement is clearly met.

But what if you left your job three weeks ago because of a serious medical problem - can you apply now or do you have to wait?

As I discuss in this video, the Social Security law says that you must have a disabling medical condition that has lasted OR IS EXPECTED TO LAST 12 CONSECUTIVE MONTHS.

So you CAN apply immediately and regardless of how long you have been out of work if your doctor is telling you that you will be out of work for at least 12 months.

So the rule of thumb to follow is this: if you are not working now and you and your doctor expect that you will be out of work for at least a full year, go ahead and apply.

Further, as a practical matter, your case will take at least 12 to 15 months before you see a judge. So if you apply today, you most likely won’t get a decision for many months in the future. There is no reason to wait. If there is one single piece of advice I can offer it's this: ACT NOW! Get the ball rolling.
