I am writing out of concern for the current gun bill being drafted in the Senate, I am concerned about the following:

RED FLAG LAWS

I am opposed to all red flag laws. It is critical that states not be compelled to enact them.

However, if one is included, I believe any law receiving federal funding must:
***Strictly limit who can apply for an order. It should be limited to law enforcement and IMMEDIATE family.
***Require a second hearing within 1 week
***Provide the accused with free legal counsel
***Provide for SEVERE (as in mandatory jail time) criminal punishment in cases of abuse
***States should be able to use funds for other programs designed to fight “gun violence”

FUNDING FOR SCHOOL SAFETY RESOURCES

Funding be provided for armed security at every school – period, This could be school resource officers, dedicated security officers or trained and armed staff.

CLARIFICATION OF DEFINITION OF FEDERALLY LICENSED FIREARMS DEALER

A clear definition of when an FFL is required is good. That said, occasional private, in state sales should continue to be a state matter.

UNDER 21 ENHANCED REVIEW PROCESS

Any “enhanced’ background checks should only be permitted until the juvenile records can be included in NICS, and that they are deleted when the subject turns 21. This should take no more than 2 years. After records are included, only a normal NICS checks should apply.

As part of this bill, FULL DELETION of all firearms records illegally digitized by ATF should be required and criminal penalties established for any further creation of an illegal registry.
