However due to this accident I recommend also recording what's going on in the rear. This guys claim is that I did something to him...um no you approached me at a high rate of speed, proceeded to be a foot off my rear, started swerving back and forth and then proceeded to pass me in a double yellow no passing zone and attempted to swerve at me, hence why the slow motion as you can see his vehicle lift up as he swerves.

This is where the education begins for those watching. I avoided the wreck, I should have held my ground and did a PIT on him and he would be 100% at fault. Wouldn't even need the dashcam as it's clearly a no passing zone and clearly no shoulder for him to claim I tried to pass on a shoulder. Next time I'm just holding my ground.

I would release more but this is an ongoing issue over a year later. I was cleared, but he was ticketed for Careless then they upped the charge due to the video to Wreckless so 4 points to now 8 points. He has hired a lawyer so I know that is costing him $2,000-$5,000 because he wants a Jury trial...LOL I know for a fact lawyers charge based on charges, and trial time so this guy is spending a LOT on his stupidity to be in a hurry. I'm sure his insurance will go up with 4-8 points. Will he walk out with nothing from a Jury trial I don't think so. Clearly I have video, hard to argue with that. At the end of the day did you pass on a double yellow Mr Mitchell, only answer is YES.

There is never a reason to pass on a double yellow. He is trying to blame me, saying I brake checked him...so why would you pass a car that was being aggressive to you? Wouldn't you maybe slow down, pull over and wait for the person to just get up ahead? Oh and YES I have video showing my driving before the passing took place...no stopping, no swerving...LOL This guy is a nutter and being old he doesn't seem to believe in the dashcam, I peg him to be in his 60's.
