CARES ACT | Home Confinement | COVID- 19 & the BOP dropping the ball

Many individuals were scheduled to be released directly to home confinement due to COVID- 19 through the CARES ACT. Hundreds of inmates were giving dates that they would be released directly to home confinement to finish out their sentences. They were put into quarantine where they would spend 14 days prior to leaving. This was such amazing news to not just the inmates but the families as well. Kids were excited to have their parents back and many even planned welcome home parties. It sounds almost too good to be true. Well for many individuals it was just that as the BOP came up with its own interpretation that stoped many inmates from leaving even after they had been given dates. The BOP decided in addition to AG William Barr's March 26th & April 3rd memo directing the BOP’s standards for emergency home confinement under The CARES Act. BOP moved the cheese, deciding that in addition to the AG’s standards, it should add the requirement that an inmate has served half of his or her sentence to be eligible for immediate home confinement placement.

After a thundering herd of inmates already in quarantine were told to move back because they were not going home, after all, the Dept of Justice muddied the waters last Wednesday even more, saying there was no 50% requirement at all.
