Winning Strategies for Trigeminal Neuralgia Disability Cases

What evidence do Social Security judges need to approve a trigeminal neuralgia case? As you know very well if you have been diagnosed with this condition, you experience severe pain in your face as a result of compression of the trigeminal nerve.

I have represented clients who have developed trigeminal neuralgia as the result of trauma - a blow to the face - or as the result of nerve damage for an unrelated surgery that unexpectedly damaged the trigeminal nerve.

As I discuss in this video, there are no consistently effective treatments for this chronic pain condition. Surgery is not always indicated or safe because the trigeminal nerve may be wrapped around a blood vessel in the brain or even wrapped around the brain stem.

Even in cases where surgery can be performed, it is not always effective and some patients develop anesthesia dolorosa, which is a chronic nerve pain condition.

More often, trigeminal neuralgia patients are treated with powerful pain medications that leave them fatigued, groggy and unable to concentrate.

In a Social Security disability context we can argue that your capacity to perform even simple, entry-level work has been greatly impaired because of pain which interferes with attention and concentration, focus, memory and pace of work. We can also argue that nerve pain medications like Neurontin, Dilantin and Tegretol create such significant side effects that you would not be capable of working an 8 hour day.

Because some trigeminal neuralgia patients experience almost constant pain, while others experience only brief episodes, disability judges expect to see medical records documenting regular bouts of severe pain. They will expect to see multiple medication trials and increasing dosages of powerful pain relievers as evidence that your condition has not been adequately controlled.
