Will Social Security Disability Pay Benefits for a Partial Disability

Social Security disability will pay you benefits if you are unable to reliably perform even a simple, entry level job. There is no such thing as partial disability under Social Security’s rules.

As I discuss in this video, some private disability insurance policies do provide for partial disability. Under these policies, you would be eligible for benefits paid by the long term disability carrier if you cannot perform the duties of your own occupation. For example a surgeon who can no longer operate because of a hand tremor would be eligible for private disability benefits under an own occupation policy.

There is no “own occupation” provision in Social Security disability law. Either you are disabled or you are not. This is why disability judges call vocational experts to testify at SSDI and SSI hearings. You may no longer be able to perform the tasks of your long time job - such as being a teacher, an administrative assistant, a factor worker or a nurse. But if you could monitor security cameras or pack items in a box 8 hours per day, 5 days per week you would not be “disabled” for Social Security purposes.

Many times the threshold question in a Social Security disability case relates to reliability, both in terms of your performance of a simple job during any particular day, and in terms of reliability over weeks and months. If the evidence in your case suggests that you would not be reliable then your chances at approval greatly improve. #partialdisabilitysocialsecurity #ownoccupation #claimsocialsecuritydisability
