"Open" and "In Person" Mean Mandatory Zoom

ID Constitution Article 1 Section 18: Courts of justice shall be open to every person...and right and justice shall be administered without...denial, delay, or prejudice. Somehow Bevin interprets this to mean that people can be shut out of the physical courts as long as they can sometimes attend over telephone or internet over zoom or youtube, if there is no technical difficulty. ID Constitution Article 1 Section 13: In all criminal prosecutions, the party accused shall have the right...to appear and defend in person... Somehow Bevin interprets "in person" to mean over the internet and makes zoom hearings mandatory and you will be arrested if you don't "appear" digitally.
Is it okay to suspend the constitution during an alleged germ emergency even thought the legislature passed a law saying you can't suspend rights protected by the constitution during a declared state of emergency? Is there no significant difference between online and in person meetings? Are there never technical difficulties or disruptions? Is it different when people have no idea who all is in the meeting? Is it dehumanizing? Does a judge have the same kind of human feeling and compassion looking someone in the eye as he does hearing them on the phone or seeing them on a computer screen deciding what to do with their life and liberty?
