Quickie: Oregon v. Kennedy

Oregon v. Kennedy abrogated one of our basic constitutional rights: protection from double jeopardy. It said that a mistrial due to prosecutorial misconduct only applies when the prosecution tries to goad a defendant into moving for a mistrial, not when they use misconduct to try to win.
