The one absolute sure-fire rule about criminal law is that a person should never, ever, under any circumstances talk to the police or give statements without benefit of counsel and without recognizing the risks. This case presents the interesting question of whether the failure to invoke the Fifth Amendment in a deposition prevents invoking that protection in a civil trial.
