SIPC refused to pay claiming Madoff Fraud Will FDIC refuse to pay and claim Bank Fraud?

The investors who lost money because of the Madoff Ponzi Scheme were supposed to be paid by SIPC SIPC claimed fraud and refused to pay I believe if multiple banks fol the FDIC will claim fraud and refuse to pay also
