DOMAIN NAME ISSUES WILL GROW EVER MORE WITH BLOCKCHAIN

Nowadays, cybersquatters and typosquatters abound. The reason is simple, for a low fee to register a domain name (I pay as low as $9.00 for mine though GoDaddy), you can create essentially a super low cost "investment" that you can try to sell or flip - think of it as a digital asset - for profit. Many domain names have been sold for HUGE DOLLARS. For example, Christmas.com just sold for over 3 million dollars. The problem becomes when the domain name involves your legitimate trademark and brand and the buyer is literally just buying your domain for the purpose of holding it for ransom (a payoff) and even worse, using your domain to clone your website or create a Phishing website that looks like your company's website. This, of course, can create a digital disaster for your brand and lead to problems with shareholders or others.

If you have a federally registered trademark, or a court has adjudicated that you have trademark rights, or if a treaty or statute declares you have trademark rights, then you are eligible to file proof of your registration with the ICANN created "Trademark Clearinghouse" and this will notify other domain name registrars that you have a protected mark and this will allow you to:

1. Be notified when someone tries to register a domain that contains one of the strings you submitted at the time of registration that uses your trademark name, or a variation thereof,

2. When a new domain name extension is launched (for example - .LegalGuide), you will be notified and have a 30-day "sunrise" period where you can pick a domain with the new extension that uses your brand. Using the "Vondeezy" example in the video, I would be notified and have a chance to register the domain Vondeezy.LegalGuide before it is launched and available to the public.

3. There is also a 60-day blocking period if someone tries to register your domain with the newly launched extension within the 60-day period.

This can be very important if your brand is often targeted by cybersquatters, or worse, a reverse domain name hijacker. Click the link above for more information about our service. Fees are reasonable from $150 for one-year protection to $725 for three-year protection (plus fees for trademark counsel). This, along with IPRR e-recordation can be two good ways to use the trademark laws in your favor.
