RESPONDEAT SUPERIOR EXPLAINED - LET THE MASTER ANSWER!

In this episode of Litigation Whiteboard® Attorney Steve® explains and defines the Latin legal term "respondeat superior," which basically means "let the master answer" for the torts committed by the employee, agent or independent contractor within the course and scope of employment. It is a policy decision that employers should bear the burden of liability for these tortious acts that occur "within the course" and scope of the employment relationship.

A hotly contested issue is the "coming and going rule" and whether or not there are "personal" deviations that should exclude or preclude liability of the employer or boss.
