2021 BitTorrent Litigation Updates. This is a ruling from 2021 but just got on my radar. In this video Attorney Steve® discusses Strike 3 Holdings, LLC and their motion to compel request for production of documents ("RFP"). A RFP can include a request to forensically image your computer hardrive, cell phones, and cloud accounts, among other things. In this case, Strike 3's motion to compel production of the hardrive and cloud data was denied. The Central District Court of California held that Plaintiff failed to use the least intrusive means possible and that disclosure of this type of evidence to Plaintiff and their foresnic expert could cause a loss of privacy, confidentiality of family information and potential disclosure of "privileged" information (ex. attorney-client communications or spousal communitcations that are protected by privilege). This, the motion to compel was denied and instead, the Court found that a "working together" approach to better streamline the search was more tenable.
