HBO documentary in "Fair Use" battle in NY

In this episode of Breaking IP News, Attorney Steve® discusses a fair use case out of New York (Second Circuit) and a case involving Joe Coleman (a painter who licenses and sells his work), alleging copyright infringement against HBO documentary films for displaying approximately 25 seconds of his painting in HBO's film "Beware the Slenderman." HBO filed a motion to dismiss arguing "fair use" applied and that there was no "contributory copyright infringement" (the judge agreed on this point and dismissed that cause of action).

However, the judge would NOT dismiss based on fair use even though there is some federal case law suggesting "documentaries" and "biographies" may be entitled to a "presumption" of fair use. The Court did not agree to dismiss at this stage of the litigation.
