1. nature of the use
2. extent of the use
3. bad faith seeking to avoid paying licensing fees?
4. large corporate defendants not training their employees (ex. a real estate company that lets its agents post whatever photos they want with no training whatsoever - we see this alot).
5. Mitigating factors (such as whether or not the infringing image was taken down after receiving notice of its unlicensed status
6. An amount sufficient to recover enforcements costs, attorney fees
7. Amount necessary to punish and deter
