WHAT IS THE LACHES DEFENSE?

In this video Attorney Steve® the intellectual property lawyer, explains the affirmative equitable defense of LACHES. It may not apply in all cases (for example, the United States Supreme Court has said it does not exist as a valid defense in patent or copyright infringement cases because these laws have a set statute of limitations (ex. in copyright infringement, it is three years from the date of discovery or the last infringing act) and that gets honored. However, in areas like fashion law and trademark, in this case, over the name "Lush," which is sold at Nordstrom, Bloomingdales, and others, the "five-year trademark contestability period" does not bar someone from bringing a LACHES equitable defense. The burden will be on the defendant to raise and prove the defense.
