Scenes-A-Faire Copyright Defense Explained

In this episode of Vondran Legal Hour Attorney Steve® discusses the doctrine of merger and the Scenes-A-Fair doctrine.

Scenes a Faire is a french term which essentially precludes copyright infringement claims where the copyrighted item at issue is not very original, amounts to essentially little more than an "idea" (which is not protected under copyright law).

Where you have a common theme, plot, or there is really only one way to express and idea, the Scenes a Fair doctrine may serve as a valuable affirmative defense (ex. for a claim of photo infringement of a skyline might be an example). In these types of cases the usual test for copyright infringement ("substantial similarity") may be more strict and the Court may require "virtually identical" copy. A photo that changes lighting or angles may not be infringing.
