Bill Cosby Retrial overview - day one developments and background

In this episode of The Verdict Nation Attorney Steve discusses the Bill Cosby Re-trial. As some of you may know, Cosby used to be known as “America’s Dad” when he played Dr. Clifford Huxtable on “The Cosby Show.” Over the years, he has been accused by numerous women of drugging and/or having sex with them. The allegations go back several decades. Now in his 80’s, Cosby is facing criminal felony trial in his home state of Pennsylvania in the Montgomery County Courthouse.

If convicted, he can spend the rest of his life in jail. He has already been sued in a civil court by the victim in this criminal trial (Andrea Constand) and it is not clear how much they settled for. The last jury was a hung trial with 10 white persons and two black persons on the jury (not that race should be an issue, but unfortunately in this society it often is).

This new trial presents some new faces and some new legal challenges including:

1. Will Bill Cosby take the stand (he did not in his last trial)
2. This trial will feature 5 corroborating witnesses (testifying to Cosby’s alleged method of operation with drugs and sex), the last trial the judge allowed only one witness
3. This trial features celebrity lawyer Tom Mesereau (he helped Michael Jackson get acquitted on child molestation charges in California in 2005.
4. There is question regarding whether or not an old civil trial deposition given by Mr. Cosby will be admissible in this trial.
5. The amount of the settlement payment (when Cosby settled with the alleged victim in the civil suit) may come into play and be disclosed. What effect will that have on the jurors?
6. Will the #MeToo movement gain steam with this case? Will it play a role in this decision of this case since most people have heard about this recent phenomenon and this was not around at the time of the last trial.
7. Does the Defendant have an “ace in the hole” (witness Marguerite Jackson) who may testify that she overheard the alleged victim stating she would get money from a high-profile celebrity (or words to that effect)?

These are some of the key developments I think we are going to see develop. We also had opening day shenanigans with a “topless protestor” who painted “Rape” on her body and ran around seeking attention for her causes. Also, juror #11 was facing dismissal when it was learned he already felt perhaps Cosby was already guilty (jurors must hold the concept of innocence until all elements of a crime are proven by the prosecutor “without a reasonable doubt.”
