Free Speech on License Plates?

Attorney Steve® discussing first amendment law in California in regard to seeking names for personalized license plates. The topic we have been discussing is whether or not "hate speech" is constitutionally protected. While in general I would say it is, there are some instances for thought and discussion. One such is seeking a personalized license plate. The State will review the meaning of your license plate and if they don't like it they could say "sorry, we think that is offensive." Is hate speech and offensive speech 100% protected?

Remember the USPTO (federal government) also previously found the Washington "Redskins" trademark name for the NFL football team "offensive" and sought to cancel the trademark.

Just food for thought on the First Amendment.
