Is using Dubsmash legal?

Dubsmash is a popular application many kids and adults alike are using on the internet to make and share funny videos. But is it 100% legal? That is a question that remains to be seen. Some copyright scholars argue it is legal under the following grounds:

1. Fair use

2. Parody

3. First amendment
