WHAT IS A DECLARATION - ATTORNEY STEVE® EXPLAINS

In litigating cases, sometimes you want to get additional evidence of the judge to consider. One way to do this is with a "declaration" by a party, similar to an affidavit, wherein a party is swearing under oath as to personal knowledge of the "declarant." This is an important litigation tool in many lawsuits, whether in state or federal court, and even in arbitrations and administrative hearings.

A declaration is a sworn statement used in a court case. It is similar to an affidavit, which is a written statement that is not sworn. A declaration can be used as evidence in a trial. It can also be used to prove that a person has knowledge of the facts in the case. A declaration can be made by any person, including a witness, a party to the case, or an expert. A declaration must be signed and dated by the person making the declaration. A declaration can be made in person or by mail. A declaration can also be made electronically. A declaration must be notarized if it is being used as evidence in a court case. A notary public must witness the signature of the person making the declaration and must sign and date the declaration. A notary public must also have a seal that meets the requirements of the state where the court case will be tried. A Declaration can be used as evidence in a criminal case, civil case, or administrative proceedings. A Declaration can also be used to prove that a person has knowledge of the facts in the case. A Declaration can be useful when there are no other witnesses to the events in question or when there are no other records of the events. A Declaration can also be used to refresh a witness's memory about what happened during an event.
