WHAT IS LAW AND MOTION?

The law and motion process is an important part of civil litigation. This is the process whereby parties file motions with the court, seeking relief on some issue related to the case. The other party then has an opportunity to file a response, after which the court will set a date for an oral argument. The law and motion process allows the parties to obtain relief on a wide range of issues, including discovery disputes and matters of procedure. In addition, the law and motion process provides an opportunity for the parties to argue their positions before a judge, allowing them to flesh out their arguments and develop a record for appeal. As such, the law and motion process is an essential part of the civil litigation process.
