Attorney Steve Vondran discusses the landmark Arizona Supreme Court case of Espinosa v. Schulenberg. This case discusses the Arizona firefighter rule and "rescue doctrine." The case involves an off-duty Arizona firewoman and her daughter, who were driving on the 101 freeway in Arizona when they ran into a 16-year-old girl who was on the side of the road. Espinosa courageously rendered aid and was injured when another driver slammed into Schulenberg, the 16-year-old driver driving the family Chevy Camaro. The Defendants argued that as a professional firefighter who gets paid to respond to emergencies, Plaintiff could not recover for her damages outside of worker's compensation. The Arizona Court disagreed and treated Plaintiff as a "volunteer" and stated that the policies undermining Arizona law is to both encourage rescue both those most qualified ("danger invites rescue," as Judge Cardozo put it) and to make these Plaintiff's whole for their foreseeable tort injuries caused by the negligence of third parties.
