A new petition for writ of habeas corpus has been filed by attorneys Mark Geragos and Cliff Gardner on behalf of Lyle and Erik Menendez. Attorneys are asking the court to open an evidentiary hearing or to vacate the convictions and sentences.

In 1998, Lyle Menendez filed a habeas corpus petition in the state
supreme court. That petition was denied without comment in 1999. In 1999, Erik Menendez filed a habeas corpus petition in the state supreme court, that petition was denied. Both defendants filed habeas corpus petitions in federal court which were denied. No other petitions for writ of habeas corpus have been filed until now.
