Who has the ultimate and final determination on who goes to heaven and who goes to hell?

Is it the Creator and Sustainer of all things, the LORD God, the Almighty?
Is it the sinner whom the scriptures declares is dead in trespasses and sins without hope in this world?

If God makes that ultimate and final decision, how is that fair to the sinner? Doesn't the Bible teach that God is fair as well as loving?

If God makes the ultimate and final decision, then why create the sinner?
