They both make good arguments. Heath says it's not a realistic lawsuit because it's not based on Arizona law. His lawsuit against Judge Thompson representing Sonny Borrelli is what caused the AZ Supreme Court to remand this in the first place. That led to Trial II and this is number III, asking the court to make MC prove the sigs are good.

Putting Trial II in context, Judge Thompson rewrote the Lake team's argument after the AZ SC kicked it back to him, to be that NOT ONE BALLOT SIGNATURE COMPARISON WAS MADE at any level, which Heath stresses is NOT the legal standard, but Kari's team went with that, maybe because an election contest is time sensitive and they had to try to win on Thompson's terms, and there was no time to let it play out in court. Heath and Donofrio seem to be making better legal arguments, to me, on Trial II than Olson/Blehm. On Trial III, Heath's reasoning (AZ leg gave MC total authority on signatures and envelopes) is not the court's as far as I can tell. The court says MC can't give up the envelopes because the signatures are private. Barnes refutes that here. Pulitzer gives details here:
