Former Procurator Fiscal David Teal seems unable to explain 'obvious' Post Office Evidence to the Post Office Inquiry.
David Teal points out that decisions that are obvious may or may not have been recorded but seems to get tangled up with what the two pieces of evidence relied upon actually meet the crucial legal test of the law of corroboration whilst admitting that a piece of evidence might not actually show a crime had taken place, despite initially saying that it showed embezzlement by the accused subpostmaster.

Subpostmasters Confession DELETED from Witness Statement!

The Post Office Inquiry has heard today that David Teale, lawyer to former subpostmaster William Quarm would like to make corrections to his submitted statements. These corrections include the subpostmasters confession DELETED from the Witness Statement!
William Quarm was convicted previously and has since had his conviction, launched by the Post Office quashed on appeal by four appeal judges.
We analyse the evidence and statement given by David Teale to the inquiry today and a response to the changes.

Prosecutor David Teale seems to be unaware of Scotland's Prosecution Code during his time as Procurator Fiscal, leading Scotland's prosecutions in subpostmasters cases when questioned on it at the Post Office Inquiry despite it being published SEVEN years before the case in question.
Despite this, he says that he would of course have this to hand and consider things such as public interest as well as the reliability, credibility and accuracy of evidence presented as part of a Post Office private prosecution case.

Prosecutor UNAWARE of ADMISSABILITY of Horizon Evidence in a case brought against subpostmaster William Quarm despite legislation covering computer generated evidence being in place in Scotland since the 1960's.
Following on from the lack of awareness of a prosecution code, David Teale appears to have another gap in legal knowledge that could have potentially prevented the case of this subpostmaster going to court.
We analyse the legislation that was in place at the time relating to the admissability of Horizon like evidence in proceedings in Scotland that was used in the this Post Office prosecution as well as David Teale's testimony to the Post Office Inquiry.

He confirms that there were 'no safeguards' in place to ensure that the Post Office was aware of their responsibilities with regards to prosecuting subpostmasters and that there were no written guidance or protocols.
Both the Procurator Fiscal and the Post Office had to trust that each other knew what their responsibilities were and that they were completing them accordingly.
