Action Radio 7/2/24, The Supremes Destroy the Administrative State! Finally!

It is known as the "Chevron Deference" arising from a case obviously involving Chevron Oil Company. The Supreme Court ruled decades ago that the Courts must defer to regulatory agencies in matters of law and the regulations they wrote, presumably because they were the "experts" and knew better than the Courts or even the Congress, what the laws really said and meant.

This has resulted in regulatory fiefdoms run by warlords, unaccountable to anyone since they are neither elected, nor can they be fired because of Civil Service protection, something that would be solved by President Trump's "Schedule F." Please see our previous show on that.

Anyway, the Court says they can interpret the laws of Congress themselves. No -- they can not. There is no "interpretations" power in the Constitution. If the Courts really want clarification on a law, they can go back and ask Congress. If it's an old law they can check the original debate. I do.

The big criticism the Court has for Chevron is that the regulatory agencies were exercising powers not delegated to the Executive, but simultaneously not realizing that they exercise legislative power all the time...
