In Authors Guild, Inc. v. HathiTrust, and confirmed by a similar case by the Authors Guild against Google, the Second Circuit Court of Appeals ruled that any use of digital books obtained without permission wasn't copyright infringement if used for a non-expressive use, such as archival or search functions.

Generative AI cases going through the courts, such as Kadrey v. Meta, will determine whether the same applies to AI training, and by the arguments given in HathiTrust, it should.
