Reports are emerging, after several “discreet actions” had been launched in support of current litigations against the government response to the COVID-19 pandemic, that Operation Midnight Train to Georgia is underway, a lite in camera action, designed to exploit the provision in the Georgia Code to require a hearing to determine probable cause, not available in many states, including Virginia. Most recently accused of “judge shopping”, one litigation hobbyist is apparently looking for an open and unlimited line of credit to overwhelm a claim of absolute and plenary prosecutorial discretion in Virginia courts that are languishing in state courts from Norfolk and Richmond to Arlington and Alexandria, while the most uneducated voters in Virginia remain totally unaware.
