Meet Dr. Kim Nguyen Chi, chief medical officer at BC Cancer.

In 2021, Chi gained public attention following an incident that resulted in his arrest by the Vancouver Police Department (VPD). If his face seems familiar, it is likely from the widely circulated video that showcased the event.

After concluding its investigation, VPD filed a report on March 28, 2021, to Crown counsel, recommending charges of mischief and assault with a weapon to be brought against Chi.

However, Crown counsel did not approve any charges.

The decision to prosecute hinges on a two-part test: whether there is a "substantial likelihood" of conviction and if the public interest necessitates a prosecution.

"With respect to the evidentiary test for charge approval, the reference to 'likelihood' requires, at a minimum, that a conviction according to law is more likely than an acquittal," said Dan McLaughlin of the BC Prosecution Service. He added that, in this context, "substantial" refers not only to the probability of conviction but also to the objective strength of the evidence.

Ultimately, Crown counsel determined that there wasn't enough evidence to present the case in court.

Neither Chi, the College of Physicians and Surgeons of BC, nor BC Cancer has publicly acknowledged the incident.
