"Do what you want, and this is Not Legal Advice but", I did a quick scan of the BoA deposit agreement, and they have certainly covered all the bases.

However, I would either come back another day or perhaps try another branch and get a certified cashier check for most of your balance (if not all, but that may look suspicious to them), and walk away from the account. Eventually they will get the picture that you are gone. Do not try and deposit a check to open an account at another bank, as apparently BoA can reverse the transfers at their discretion. The hook is that unless you have a huge amount of money, it will never be worth taking it to court to retrieve it.
