In this episode of Not On Record, Joseph and Diana discuss a recent case where the Crown conceded acquittal after cross-examination. The case involves a date gone wrong, beginning with two people meeting at a bar, having met a week prior, and going home together. However, their stories diverge significantly afterward. A key issue was the complainant's overstatement of her intoxication level, claiming she was virtually catatonic and a "puppet," unable to move or speak, yet she was supposedly transported to multiple locations and even had a full conversation with a friend that she later forgot about. The complainant's credibility was further questioned regarding a "fictitious friend" and inconsistencies in how the accused obtained her address. Ultimately, the prosecutor, after careful consideration of the cross-examination, recognized the complainant's statements as a fabrication and decided not to pursue the conviction.
