Big Nothing Burger FOIA Case Continues to Languish in Court Against White House and Meta Platforms, Inc.

Ask any politician in front of a microphone and, when it comes to FOIA, a popular investigative journalism tool for the press, “The American people need to know.” Yet, one case, with high profile defendants, including the world’s largest social media platform, Meta Platforms, Inc., and the now unpopular White House, has yet to even warrant a joke on Jimmy Kimmel Live! How could a high profile client like Meta, retain a rising star, society page nuptials, bet-the company litigation partner at the San Francisco-based Orrick, Herrington & Sutcliffe, the firm founded the same year as Levi Straus, and that had arranged the financing for the Golden Gate Bridge, as well as BART, and not be mentioned anywhere in the press, after litigation had challenged the permanent disabling of an internationally notorious porn tab guy’s account, expressly for “security” reasons? And yet on a matter not even two Presidents have claimed to be classified, has been before federal courts since Indenpendence Day weekend in 2021. Why?

The Freedom of Information Act (FOIA) isn’t exactly a trip to Las Vegas, and more like a trip to a gumball machine. You drop in a coin or slug, and out pops the gumball, unless one of nine reasons prevents disclosure. And generally, if an agency says they had a reason to withhold information, or even better, if they claim no information exists, that ends the inquiry. And yet, not even White House attorneys with a summary judgment motion filed in what they had repeatedly described as a “ripe for dismissal case” have prevailed, against, of all things, at most, maybe an army barracks lawyer, with stories that have spawned allegations of stolen valor. What gives? They don’t want to hurt the wacko’s feelings?
