CLASS #500: The Progressive Spirit (Elitism & Contempt) in Hamilton's Defense of the Judiciary (Part I)

In Federalists #78 & &9, Hamilton tried to explain why the fears over the Judiciary, as defined in the Constitution, were unfounded. He claimed that the Judiciary was the weakest branch of the proposed government and, therefore, not to be feared. But his arguments were profoundly flawed, filled with fallacious assertions, even to the point of self-contradiction. What';s more, he never really addressed or assuaged the fears of the Antri-Federalists. Rather, he reveals what The RTC refers to as his 'Progressive spirit:' his sense of elitism and his contempt for the People and their representatives. As a result of Hamilton's work, the Constitution was ratified as presented and the Anti-Federlists' fears have now come back to haunt us -- just as they predicted they would. We will attempt to explain Hamilton's position, his mistakes and his Progressive spirit in today's class. We hope you'll join us.
