Copyright claim- Oh no!!! And what to do about it

Oh no I received a copyright claim from ITV Good Morning Britain’s breakfast news programme for using a measly 1 minute and 5 seconds of a news article about grooming gangs in which the public was asked to help in any way they could

Of course I have appealed this copyright claim as I believe myself to be fully compliant with the exemptions and exceptions to copyright law

As stated in today’s video I wholeheartedly support the Maggie Oliver foundation and would happily donate any monetisation from the copyright claimed video to this charity and you can also contribute if you feel called to do so here;

My 4 points for appealing this copyright claim are as follows;

I appealed the copyright claim under fair use policy and in particular with reference to:

1) The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes.

I am a small channel and have not yet monetised at all – I believed myself to be fully compliant with fair use policy in making this video for educational purposes – I have previously made videos about grooming gangs and so this is a subject matter that I have worked on before and prior to the ITV article

2) The nature of the copyrighted work.

I believe that the subject matter discussed – Grooming Gangs is very important and should be discussed between citizens just as much as it is via mainstream news – in fact Maggie Oliver requests help from the public in this particular news article aired by ITV – Which I have responded to by making a video about it

3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4) the effect of the use upon the potential market for or value of the copyrighted work.

Once again – I do not believe I have made any impact on the potential market value of the entire article and in fact may have increased the amount of people who subsequently went on to view the article in full as a result of seeing that small clip at the end of my video – which was fully referenced in the description box
