Rights Lost in Gem County Idaho?

Does the Gem County Mosquito Abatement District's (GCMAD) power supersede your property rights or informed consent?

Wendy Roxas and others in Gem County Idaho want to opt out of mosquito abatement spray and should be able to according to Idaho Code 39-2804. Wendy explains the ridiculous run around they are getting including the excuse that aerial spraying of Naled doesn't apply to the land owners ability to opt out. Is that how you read the law?
