On the day of his inauguration Trump signed an Executive Order titled "Protecting the Meaning and Value of American Citizenship." This order has been widely reported as "overturning" the "long-standing" doctrine of so-called "birthright citizenship"--the notion that anyone born on American soil is automatically an American citizen as a result. The major foundation for this mistaken claim is the 14th Amendment.

In fact, America in general and the 14th Amendment in particular has never recognized or created any such concept of "birthright" citizenship, and Trump's Executive Order merely recognizes that legal and political reality.

Several groups have filed federal lawsuits against Trump's Executive Order on citizenship, and now the matter is before the US Supreme Court. As part of that process, many other interested groups are filing "friend of the court" amicus briefs on one side of the dispute or another.

One of those amicus brief just filed in support of the proper understanding of law that so-called "birthright citizenship" is a legal fiction was prepared by the Claremont Institute, a conservative think-tank.
