Concord suspect charged with attempted murder after he was shot at when he pointed a gun at officers

Concord, CA - A man accused of pointing a gun at Concord police officers while fleeing a traffic stop last month clearly reaches for something at his ankle and later appears to point it at police, according to the department.

Prosecutors last month charged Eric Foreman, 37, of Richmond, with two counts of attempted murder and two counts of assault on a peace officer in the aftermath of the April 3 confrontation, according to court records. He remains in jail at the Martinez Detention Facility in lieu of $4.4 million bail, according to jail records.

The police shooting did not injure anyone, police said. Foreman did not fire any shots.

In a statement released along with officer body-worn video and surveillance security video of the incident, police identified the two officers who fired as Michael Kinnison and Michael Schneider.

The chaos started about 10:10 p.m. when Kinnison tried to pull over Foreman on Ellis Street near Clayton Road. At some point in that process, Foreman hit another car in a parking lot, police said. He then got out of the car and tried to run through an apartment complex, police said.

Video from Kinnison’s body-camera shows Kinnison yelling “Stop, stop!” and drawing his gun just as he begins to run after Foreman. The chase goes through the parking lot and across Clayton Road and into the parking lot of the Pet Smart in the 1700 block of Willow Pass Road.

Kinnison’s body camera shows Foreman stopping in the parking lot, reaching down to his ankle and pulling what appears to be a gun. It also shows the apparent barrel of the gun held high in Kinnison’s direction. Two still images from the same video also appear to show Foreman pointing the gun.

Security video included with a Concord police statement also captured the scene and clearly shows Foreman reaching to his ankle and appearing to emerge with a weapon that he points at Kinnison. Video then shows the ensuing gunfire, Foreman falling down, getting up and continuing to run.

Police said that after those shots, Foreman continued to run with the gun toward Clayton Road, where Schneider saw him. Schneider’s body-worn camera captures him screaming at Foreman to “Drop the gun! Drop the gun!,” and shows Foreman ignoring the commands and apparently pointing a gun in Schneider’s direction.

Schneider then takes cover behind the patrol car and fires his weapon, video shows and police said. That gunfire happened as Foreman runs toward the Sutter Plaza parking lot located in the 1800 block of Sutter Street, police said.

Security video from a nearby business released by police also appears to show Foreman pointing a gun Schneider.

A police dog with the Contra Costa Sheriff’s Office led deputies to Foreman about an hour later after authorities surrounded the area. Foreman suffered some undisclosed injuries from the police dog but was later released from a hospital.

Police said they found Foreman in possession of a loaded FN Five-seveN pistol with a live round in the chamber and a firing pin indentation that indicates it had been fired.

The sheriff’s office also used a drone team to help find Foreman, and officers from Pittsburg and Pleasant Hill also helped surround the area.

Court records show that prosecutors also charged Foreman with a misdemeanor for obstructing officers.
