On 03/08/2025 Pinellas County Florida Florida Fish and wildlife officer witnessed a vessel returning after dark with improper navigation lights. During safety inspection a number of empty beverage containers were discovered, plus clear box containing the white plastic medical marijuana containers. with gummies in it.
The captain continued to complain over and over about his Sea Legs.
But arrested and taken for: BUI OPERATING A VESSEL WHILE NORMAL FACULTIES IMPAIRED,
REFUSAL TO SUBMIT TO BLOOD/BREATH/URINE TO PURSUANT TO FS327.352
POSSESSION MARIJUANA

Upon arriving at CBT, 20-minute observation (9:27 pm). While attempting his first breath sample, Captain
acted like he was blowing multiple times. After multiple attempts, Vessel Captain finally supplied a sufficient volume of air to provide a test result. During the
second breath sample, provided a breath sample without issue. The breath test results were 0.029 g/210L and 0.029 g/210L.
Extrapolation of BAC:
Given Data:
• BrAC at time of test: 0.029
• Time elapsed since contact: 2 hours 45 minutes (2.75 hours)
• Metabolism rate: ~0.015 BAC per hour (average for an adult male)
Step 1: Convert BrAC to BAC
Using the standard partition ratio (2100:1):
BAC = BrAC \times 2100
BAC = 0.029 \times 2100 = 0.0609\%
Step 2: Estimate BAC at Time of Contact
Alcohol is metabolized at approximately 0.015% per hour, so over 2.75 hours:
0.015\times 2.75 = 0.04125
Estimated BAC at time of contact = 0.0609 + 0.0413 \approx. 0.102\%
Final Estimate:
At the time of contact, the individual’s BAC was approximately 0.102%.
