Do AI companies have the right to use products without paying for them?

Many AI Companies are currently under lawsuits for fair use, copyright, etc. because they have used thousands if not millions of songs, books, etc. to train their AI. Does this constitute fair use? Is it okay when that knowledge can be used to recreate and and publish hundreds of monetizeable products.
