Is Islamophobia justified?
Some further points of note: (1) Islamic law introduces the blood price as a way between the Mosaic principle of retaliation and the Christian principle of forgiveness (Bukhari 65:25). (2) The role of the state/Caliph is to act as a witness and encourage the victim to forgive the perpetrator or accept the blood price—even to compensate the victim from the public treasury, if necessary (Bukhari 78:169). (3) As a rule, any Islamic law can be proven with the Bible (Qur’an 3:93). While Jews may seem to follow the harshest laws, the “laws” of Christians and atheists in practice are by far the harshest and most arbitrary, because they have no limits (hudood). The “limits” of Islamic law are murder and treason, including adultery and apostasy, which fence the “pasture” of what is permissible or Halal (Bulugh al-Maram 16:1468). Islamic law is unique in that (i) it only applies to Muslims who voluntarily swear allegiance to the Prophet or Caliph; moreover, (ii) Muslims are familiar with the law, since they routinely read the Qur’an (“recitation”) or hear it recited in prayers; in addition, (iii) Muslims believe that only the laws of God are valid, rather than would-be gods who seek to impose their will on others. Tyranny and Islamophobia thus go hand in hand. (4) In regards to slavery, it should be noted that a slave can only be taken as a concubine if she is a Jewess or a unitarian Christian who observes biblical law (Bukhari 68:34) and consents (Malik 36:1418). In addition to the obligation to feed, clothe and lodge slaves like their owners, and not to value them differently because of their race (Malik 31:1293), slaves must be treated with kindness and not overworked (Muslim 27:63). It should finally be borne that Sharia covers the broadest and most diverse geography and population, unlike any other system of law, of which it is the oldest and most successful by far. As such, it deserves the highest respect and consideration, especially by critics if they are serious, and should not be misrepresented or maligned.
