Trump’s Birthright Citizenship Executive Order Set to Go in Effect Next Month

The Supreme Court ruled on June 27, 2025, to limit the use of nationwide injunctions, which are court orders that block government actions or policies across the entire country. This decision came in response to a case involving President Donald Trump’s executive order on birthright citizenship, which had been blocked by several federal judges through nationwide injunctions.

President Trump’s Executive Order that outlines the 14th Amendment interpretation of requiring a mother or father of the child to be an American citizen, will go into effect 30 days from the Supreme Court’s decision, which ruled federal judges can’t use nationwide injunctions. Each state will have to recognize the order or decide to be noncompliant, risking their availability to federal funding, if noncompliant.

The woman in this newscast was issued a tourist visa. This new ruling will by extension, will end the birth tourism industry for states that recognize this Executive Order. Birth Tourism has largely resulted from a relaxed interpretation of the 14th Amendment, allowing anyone born on U.S. soil to be considered an American citizen. Many foreigners come to the United States on tourist visas, have their babies and then leave to return to their home countries. Then send their children, as ‘Americans’ who grew up in other countries, to American Universities, with the same benefits as any American may who may receive loans and tuition assistance, or any other entitlement program benefits typically reserved for American citizens.
